Terms of Service

1. Agreement to Terms

By accessing or using MockupGen AI at mockupgenai.com ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and MockupGen AI.

2. Service Description

MockupGen AI is an AI-powered mockup generation tool. You upload app screenshots, and the Service uses artificial intelligence to generate marketing mockups in multiple formats including App Store, Google Play, social media, and other marketing graphics. The AI processing is powered by Anthropic's Claude API, with images stored on Cloudflare R2.

3. Eligibility

You must be at least 18 years old or the legal age of majority in your jurisdiction (whichever is higher) to use the Service. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Account Responsibilities

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to:

  • Provide accurate and complete information when creating your account.
  • Keep your account information up to date.
  • Notify us immediately through our contact form if you suspect unauthorized access to your account.
  • Not share your account or transfer it to another person without our consent.

5. Acceptable Use

You agree not to use the Service to:

  • Upload or generate content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
  • Violate any applicable laws or regulations.
  • Infringe on the intellectual property rights of others.
  • Attempt to reverse-engineer, decompile, disassemble, or derive the source code of the Service or its AI models.
  • Use automated scripts, bots, scrapers, or other programmatic means to access the Service or circumvent usage limits.
  • Redistribute, resell, or sublicense the Service itself (generated mockups for your own use are permitted).
  • Interfere with or disrupt the integrity, performance, or availability of the Service.
  • Attempt to gain unauthorized access to other users' accounts or data.

We reserve the right to suspend or terminate accounts that violate these restrictions, with or without prior notice.

6. Intellectual Property

Your Content

You retain all rights to the screenshots you upload. By uploading content, you grant us a limited, temporary, non- exclusive license to process your images solely for the purpose of generating your requested mockups. This license terminates when your data is deleted per our retention policy.

Generated Mockups

You own the mockups generated from your uploaded content, subject to the following:

  • Paid tiers: You receive a full, perpetual, worldwide license to use, modify, and distribute your generated mockups for any lawful purpose upon payment.
  • Free tier: Generated mockups include a watermark. You may use watermarked previews for evaluation purposes. Full, unwatermarked usage requires a paid subscription.

Our Service

The MockupGen AI service — including its design, code, algorithms, AI models, templates, branding, logos, and documentation — is owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, service marks, or branding.

7. Payment & Subscriptions

Paid subscriptions are billed on a recurring basis (monthly or annually) through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

Cancellation: You may cancel your subscription at any time from your account settings. Upon cancellation, you retain access to paid features until the end of your current billing period.

Refund policy: First-time subscribers may request a full refund within 7 days of purchase, provided no more than 1 generation has been used. If 2 or more generations have been used, no refund is available as the Service has been materially consumed. No refunds are provided for partial billing periods. Price changes: We reserve the right to change our pricing. We will notify you at least 30 days before any price change takes effect. Continued use of a paid plan after the price change constitutes acceptance of the new pricing. If you do not agree, you may cancel before the new price takes effect.

8. Free Tier

The free tier provides limited access to the Service with the following restrictions:

  • Limited number of mockup generations.
  • Watermarked output on generated mockups.
  • 7-day data retention.
  • Access to a subset of formats and templates.

We reserve the right to modify, limit, or discontinue the free tier at any time without prior notice. The free tier is provided as-is without any service level guarantees.

9. Service Availability

We strive to maintain high availability of the Service, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Planned maintenance (we will notify you when possible).
  • Third-party service outages (Kinde, Stripe, Anthropic, Cloudflare).
  • Circumstances beyond our reasonable control.

We do not provide a formal Service Level Agreement (SLA) and are not liable for any downtime or service interruptions.

10. Limitation of Liability

To the maximum extent permitted by applicable law, MockupGen AI and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to your use of the Service, regardless of the cause of action or the theory of liability.

Our total aggregate liability for all claims related to the Service shall not exceed the total amount you paid us in the twelve (12) months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law, including mandatory consumer protection provisions under EU law.

11. Indemnification

You agree to indemnify, defend, and hold harmless MockupGen AI and its operators, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of the Service in violation of these Terms.
  • Content you upload that infringes on the rights of third parties.
  • Your violation of any applicable laws or regulations.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • AI-generated mockups will meet specific requirements or standards of any app store or platform.
  • The Service will be error-free, secure, or uninterrupted.
  • Results from the AI will be accurate, complete, or suitable for your intended use.

13. Termination

By you: You may delete your account at any time from your account settings. Upon deletion, your data will be removed in accordance with our Privacy Policy retention schedule.

By us: We reserve the right to suspend or terminate your account at any time if you violate these Terms, engage in abusive behavior, or if we determine (in our reasonable discretion) that your activity is harmful to the Service or other users. Where possible, we will provide notice before termination.

Effect: Upon termination, your right to use the Service ceases immediately. Any data associated with your account will be deleted per our data retention policy. Provisions that by their nature should survive termination (including Sections 6, 10, 11, 12, 14, and 15) will survive.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to conflict of law principles. Mandatory consumer protection laws of your country of residence shall apply where required by EU Regulation 593/2008 (Rome I).

Dispute resolution: In the event of a dispute, we encourage you to reach out through our contact form to seek an amicable resolution. If we cannot resolve the dispute within 30 days, either party may submit the dispute to the competent courts in Poland.

EU consumers:If you are an EU consumer, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

15. General Provisions

Severability: If any provision of these Terms is held to be unenforceable, the remaining provisions shall remain in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and MockupGen AI regarding the Service, superseding any prior agreements.

Waiver: Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights. Any waiver must be in writing and signed by an authorized representative.

Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

16. Changes to These Terms

We may revise these Terms at any time by posting an updated version on this page. Material changes will be communicated via email or a prominent notice on the Service at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
